Terms of Service

Please read these Terms of Service ("Terms") carefully before using Sukimori (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Important: These Terms include a mandatory arbitration provision and a class-action waiver in Section 12. By using the Service, you agree to resolve disputes through binding individual arbitration rather than in court, except as described in that section.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use Sukimori. By creating an account, you represent that you meet this age requirement, that you have the legal capacity to enter into a binding agreement, and that your use of the Service is lawful where you live. Sukimori is designed for use by adults in consensual relationships.

2. Your Account & Partner Linking

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. When you link with a partner, certain activity and content — including quest activity, journal entries, photos, and messages — is shared between your linked accounts. You may unlink at any time from Settings. Once content is shared with a linked partner, we cannot control how they view, store, or share it. Notify us immediately of any unauthorized use of your account.

By using the Service, you consent to receiving service-related messages from us — including account, billing, security, and product notifications — through in-app notifications, push notifications, or to the email or phone number associated with your account. You are responsible for keeping your contact information current; we are not liable for messages you fail to receive due to outdated contact information. You can control marketing communications and push notification categories from Settings.

3. Subscriptions & Billing

  • Sukimori offers a 14-day free trial and a Premium subscription. One subscription covers both you and your linked partner. If you do not subscribe by the end of the trial, your access to paid features ends.
  • Web subscriptions are processed by Stripe; mobile subscriptions are processed by Apple or Google. Sukimori never stores your payment card details.
  • Subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal.
  • You may cancel at any time — through the Stripe billing portal for web subscriptions, or through your Apple or Google account settings for mobile subscriptions. Access continues until the end of your paid period.
  • Web subscriptions purchased through the Site may be refunded within ten (10) days of the initial purchase by contacting support. After that, payments are non-refundable except where required by law. Refunds for mobile subscriptions are handled by Apple or Google under their respective policies.

4. App Store Terms

If you access the Service through the Apple App Store or Google Play Store, your use is also subject to those marketplaces' rules. Where their rules conflict with these Terms, the marketplace rules apply to that conflict. Apple and Google have no obligation to provide support or maintenance for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

5. Acceptable Use

You agree not to:

  • Use the Service if you are under 18 years of age
  • Share your account with anyone other than your linked partner
  • Upload, share, or create content that sexualizes or depicts minors in any context (we have a zero-tolerance policy)
  • Upload illegal content of any kind
  • Use the Service for any non-consensual purpose, or to harass, stalk, threaten, coerce, surveil, or monitor any person — including a current, former, or prospective partner — without their informed consent
  • Impersonate any person or misrepresent your identity
  • Send unsolicited invitations, advertising, or spam
  • Transmit viruses, malware, or other harmful code
  • Reverse-engineer, scrape, probe, or otherwise interfere with the Service or its security

We may report activity we reasonably suspect violates the law to the appropriate authorities and cooperate with their investigations.

6. Your Content

You retain ownership of the content you create through the Service. By making content available through the Service, you grant Sukimori a non-exclusive, worldwide, royalty-free license to host, display, and deliver that content as needed to provide the Service to you and your linked partner. We will not use your private couple-to-couple content (such as journal entries, private photos, or messages with your partner) for advertising or marketing outside the Service. You are solely responsible for the content you create and share, and you warrant that it does not violate any law or infringe on anyone's rights. We may remove content that violates these Terms or that we otherwise find objectionable.

7. Health, Safety & Consent

Sukimori is not a healthcare provider, counselor, or licensed therapist. The Service is provided for informational and entertainment purposes only and is not a substitute for professional medical, psychological, or relationship advice. If you or your partner are experiencing a crisis — including abuse, self-harm, or threats of violence — please contact a qualified professional or emergency services.

Participation in any activity prompted by the Service requires the ongoing, freely given consent of all participants. Either partner may pause, decline, or end any activity at any time for any reason. Nothing in the Service overrides real-world consent.

8. Service Availability & Updates

We do not guarantee that the Service will always be available, uninterrupted, or error-free, and we may suspend, modify, or discontinue any part of it without notice. We may release updates from time to time; if you choose not to install them, you may not be able to continue using the Service or it may not work as intended.

9. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You understand that the Service involves personal, intimate, and potentially explicit content, and you access and use it at your own risk.

To the maximum extent permitted by law, Sukimori and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Sukimori and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party right.

11. Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms or are creating risk or legal liability for us or other users. You may delete your account at any time from Settings; your data will be handled in accordance with our Privacy Policy. Termination does not entitle you to a refund of any subscription fees already paid, except as required by law or by the policies of the relevant app marketplace.

12. Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of the jurisdiction in which Sukimori is incorporated, without regard to its conflict-of-law rules.

You and Sukimori agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, and not in a class, representative, or consolidated action, unless otherwise required by law. You and Sukimori each waive the right to a trial by jury and the right to participate in a class action. You may bring qualifying claims in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights. You may opt out of arbitration by sending written notice to support@sukimori.com within thirty (30) days of first agreeing to these Terms.

13. Changes to Terms

We may update these Terms from time to time. For material changes we will provide reasonable advance notice by email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you don't agree, stop using the Service and you may delete your account.

14. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Sukimori regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right isn't a waiver of that right. You may not assign these Terms without our consent; we may assign them without restriction. We are not liable for delays or failures caused by events beyond our reasonable control.
